Terms Of Service

Projects Restrictions

We do not accept projects that promote hate speech, extremist political content, sexually explicit material, violence, or any content that violates laws or ethical standards. We reserve the right to refuse or cancel projects that include such content without refund.

Content Restrictions

To maintain ethical standards and comply with legal requirements, Sproutouts strictly prohibits the creation of websites, design work, or content of any kind that includes, promotes, or endorses any of the following:

Hate speech, discrimination, or content that promotes violence or hatred against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.
Extremist political content or propaganda that promotes intolerance, violence, or illegal activities.
Sexually explicit material, pornography, or content containing sexual innuendo.
Graphic violence, threats, or any content that incites harm or illegal behavior.
Any content that violates applicable laws or regulations.
We reserve the right to refuse, suspend, or terminate any project or service that violates these restrictions without refund.

Intellectual Property and Legal Disputes

All artwork, icons, and design elements available in the Sproutouts shop that are not customized or altered remain the exclusive copyrighted property of Sproutouts. These items must not be claimed as copyrighted or exclusive by any other business or individual in any form.

Semi-custom or customized designs may include elements that clients can claim copyright over, such as text-only logos unique to their brand. However, Sproutouts retains ownership and copyright of all original artwork and icon designs, regardless of customization.

Sproutouts disclaims any responsibility or involvement in legal disputes or claims between clients or third parties regarding the use, copyright, or ownership of designs purchased from the shop.

It is the sole responsibility of each client to pursue and maintain copyright or trademark protection for any elements they are entitled to, including but not limited to text-based logos unique to their business.

By purchasing from the Sproutouts shop, you agree to these terms and acknowledge that any legal conflicts arising from copyright or trademark claims are your responsibility to resolve without involving Sproutouts.

Semi-Custom Brand Logos & Artwork Copyright Details

By purchasing any semi-custom project from Sproutouts that includes artwork or logo/submark designs incorporating icons or other graphic elements, you acknowledge and agree that the original artwork and icon designs remain the exclusive copyright property of Sproutouts. These designs are not transferred to you as unique copyrights and remain available for use in other projects or by other clients. If you want completely custom design work, please contact us to book a separate project or to see if additional custom design work can be added to your current project.

Additional Notes:

  • If you purchased all copies of a semi-custom brand identity, this may change your ability to copyright. Please ask us for additional details if this is the case!
  • If your brand includes any text-only logos or submarks, they may be eligible for copyright protection as these logos contain only elements unique to your business (your unique brand name or tagline).

In all cases, copyright protection applies only to the specific designs created for you, not to the underlying original design concepts owned by Sproutouts. It is your responsibility to pursue trademark registration if you wish to protect your logo(s) as brand identifiers. For more information on trademarks, please visit www.uspto.gov/main/trademarks.htm if you live in the U.S. Sproutouts does not provide legal advice. We share copyright information based on our current understanding, but recommend consulting a qualified attorney for professional legal guidance.

Sproutouts Shop Design Work

You acknolwedge and agree that designs purchased through the Sproutouts shop (or designated shop items used in invoiced projects) may still resemble the original source designs depending on the level of customization included. You acknowledge that all original shop designs remain the exclusive property of Sproutouts, including those incorporated into their project, and Sproutouts retains all copyright ownership and rights to sell these original designs. This approach helps keep our design work affordable, and we appreciate your understanding.

Purchased assets are approved for commercial use and may be incorporated into your original products, including but not limited to product packaging, marketing materials, and merchandise unique to our brand. However, all shop products are intended for personal or single-business use only. Sharing, reselling, redistributing, or attempting to copyright original shop files is strictly prohibited. Additionally, any shop items not customized specifically for you by Sproutouts may not be modified or altered for resale or distribution as your own work, such as adapting and reselling guides, icons, or other original designs created by Sproutouts.
